Terms of Service

1. Acceptance

By accessing ternith.ai or using Ternith, you agree to these Terms. If you use Ternith for an organisation, you confirm that you have authority to accept these Terms for that organisation.

These Terms are between you and Daniel K Cheung, operating the product known as Ternith. Ternith is not currently a registered company or separate legal entity.

You must be at least 16 years old to use Ternith.

2. What Ternith provides

Ternith is an AI-visibility diagnostic service. It measures how AI systems treat a brand and diagnoses which of three failure modes is most likely causing the visibility problem: discoverability, compellingness or positioning.

• Ternith provides evidence, observations and diagnostic outputs.
• Ternith does not provide a composite visibility score.
• Ternith does not guarantee that a recommended business, content or SEO action will produce a specific result.
• Ternith outputs are decision support, not legal, financial, marketing or professional advice.

3. Waitlist and pre-launch access

The public site is currently pre-launch. Joining the waitlist does not guarantee access, pricing, timing or availability.

We may change, pause or withdraw the waitlist or any pre-launch feature at any time.

4. Accounts

When accounts are available, sign-in may use email magic links. You are responsible for keeping your email account secure and for all activity under your account.

You must provide accurate account and billing information. We may refuse, suspend or terminate access if we reasonably believe the service is being misused.

5. Your inputs

You are responsible for the brand names, URLs, domains, prompts, context and other material you provide. Only submit material you have the right to use, and do not submit private, confidential or sensitive personal information unless we have explicitly agreed how it will be handled.

You grant Ternith a limited right to process your inputs, retrieve public pages and generate outputs as needed to provide, secure and improve the service.

6. Diagnostics and inconclusive results

A paid diagnostic may require two measurement runs on separate days. Ternith names a failure mode only when the evidence meets the product's diagnostic rules. If the result is too close to call, unstable or otherwise not strong enough, the output may be inconclusive.

An inconclusive result is not a service failure. It is one of the defined outcomes of measuring noisy AI systems honestly. Where the paid product includes a Resolution Run credit, the credit is the stated remedy for that outcome.

7. Payments

Paid access, when available, will be processed through Stripe. Stripe handles card details directly. Prices, inclusions, taxes and refund terms will be shown before purchase.

Unless stated otherwise at checkout or required by law, paid diagnostic work is non-refundable once measurement work has started.

8. Acceptable use

• Do not use Ternith for unlawful, harmful, deceptive or abusive activity.
• Do not submit malware, credentials, private personal data or material you are not allowed to process.
• Do not try to bypass access controls, rate limits, metering or security controls.
• Do not scrape, resell or reverse engineer the service except where law expressly allows it.
• Do not use outputs to make automated decisions with legal or similarly significant effects about people.

9. Ownership

You keep ownership of your own inputs. Ternith keeps ownership of the service, software, methodology presentation, templates, documentation and brand assets.

Subject to payment and these Terms, you may use diagnostic outputs for your internal business purposes. You may not present Ternith outputs as if they were produced by another system or remove required provenance where a report includes it.

10. Third-party services

Ternith depends on third-party hosting, payment, email, AI, analytics, search and public web-retrieval providers. Their availability and behavior can affect the service.

11. Disclaimers

The service is provided as is and as available. To the maximum extent permitted by law, we disclaim warranties of accuracy, availability, fitness for a particular purpose and non-infringement.

Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law or any other law that applies to you.

12. Liability

To the maximum extent permitted by law, Ternith is not liable for indirect, consequential, special or punitive loss, including lost profits, lost revenue, lost data, reputational harm or wasted business spend.

Subject to non-excludable law, our total liability for all claims is limited to the amount you paid Ternith in the 12 months before the claim, or AUD 100 if you have not paid anything.

13. Termination

You may stop using Ternith at any time. We may suspend or terminate access if you breach these Terms, create risk for the service or others, or if we are required to do so by law.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction.
